According to Fox5, Chief Justice David E. Nahmias said, “There are really three theories that explain his action.
“Either McIver shot his wife on purpose, as alleged, or he committed aggravated assault and felony murder.” Or he handled a firearm recklessly in the back of a moving vehicle, committing felony involuntary manslaughter.
Or the firearm was accidentally discharged.
Attorney Don Samuel attempted to persuade the justices that the jury should have had the option of convicting McIver on lesser charges, such as criminal negligence.
The Fulton County superior court judge, according to Samuel, should not have permitted the jury to sit inside the McIver SUV.
He claims that the state introduced systemic racism into the case.

Tex Mclver, an Atlanta lawyer was arrested for killing his then-64-year-old wife, Diane Mclver. But he claims it was an accident.

McIver asked his wife, who was sitting in the front passenger seat, to pass him a gun from the center console. He stated that he was uncomfortable with the area where they exited.
However, they were all shocked to hear McIver fired the gun once a short time later hitting his wife in the back. Carter drove Diane to the hospital, where she died.
