Justin Hansen got charged with assaulting Brittani Marcell in her northwest Albuquerque home with a shovel back and was sent to jail in 2018.

Marcell remained in a coma for two weeks before waking up with no memories of her attacker until 2017, when she recognized his name.

She informed investigators she remembered him from her Cottonwood Mall workplace. Marcell and her family were in court to hear the State’s motion to keep Hansen in custody without release.

Hansen filed an appeal last year, requesting credit for the 371 days he spent on a GPS monitor, but the case got dismissed this week. Recently, his request has been granted by the Appellate Court. 

According to the District Attorney’s Office, the time spent would be removed from his previous sentence rather than a formal resentencing hearing.
