PUTNAM COUNTY, W.Va. (WCHS/WVAH) — After deliberating long into the night Friday, a jury has found a man accused of driving past a school bus and hitting and killing a man in 2018 in Putnam County guilty of second-degree murder. Morgan Creed Vandergriff was found guilty of second-degree murder at 9:30 p.m. Friday night on the fourth day of the trial.
Vandergriff was originally charged with first-degree murder. Friday afternoon, the prosecution asked the judge to allow the jury to consider lesser charges of second-degree murder and manslaughter. Vandergriff is accused of passing a school bus in Scott Depot in May of 2018, hitting and killing John Maynard.
Witnesses said Maynard was trying to get Vandergriff’s car to slow down for a stopped school bus on Ranch Lake Boulevard, but Vandergriff ran off the road and hit Maynard. On Wednesday, seven witnesses recounted what they saw during the time Vandergriff hit Maynard with his car. New evidence also was shown in court that painted a better picture of how it all unfolded.
Frantic 911 calls were played in court, revealing what happened right after Maynard was hit and killed. “He was like a son to us, and he was our neighbor and friend,” neighbor Eleanor Edwards said. Two witnesses saw the moment Maynard was run down in their neighborhood. The father and husband were trying to flag down Vandergriff’s car to slow him down. Vandergriff faces up to 40 years in prison.
