How to write a stat dec nsw

Who can witness a statutory declaration in NSW?

In New South Wales, an authorised witness must be a:
  • justice of the peace.
  • notary public.
  • commissioner of the court for taking affidavits.
  • legal practitioner, i.e. an Australian lawyer who is granted a practising certificate under:
  • any person authorised to administer an oath.

Where do I get a stat dec form NSW?

Templates for a statutory declaration are also available in either PDF form or editable DOC form on the NSW Department of Justice website.

What is a statutory declaration NSW?

A statutory declaration is a written statement which a person swears, affirms or declares to be true in the presence of an authorised witness — usually a JP, lawyer or notary public. A NSW statutory declaration is made under the Oaths Act 1900.

What is an example of a declaration?

An example of a declaration is a government’s statement about a new law. A statement that is assumed to be truthful because it is made by an individual aware of impending death (and thus thought to have no incentive to lie), and that is therefore admissible in court as an exception to the hearsay rule.

Can Australia Post certify documents?

In most cases, Post Office staff can certify documents as being true copies of the original document. As part of their service, they will photocopy your original document and stamp it to verify it’s a true copy.

Can a JP certify a document not in English?

Since a JP generally has no concern with the contents of any documents produced for his or her attestation, it matters only that the copy is a true copy of the original. Some Justices of the peace have indicated on the public JP Register that they can speak a language other than English.

Can a family member witness a signature?

It is a statutory requirement that the witness must be present when the executing party signs the deed. Where it is not possible to be in the physical presence of an independent witness, then a family member or cohabiting individual will suffice, providing the witness is not party to the documents or wider transaction.

Can a wife witness a signature?

We would usually recommend that an ‘independent’ witness should ideally not be a spouse, civil partner, co-habitee, or other close family member of the person signing. However, in current circumstances some relaxation to ‘best practice’ may be required – see below.

Is it safe to witness a signature?

Quite simply, no. The practice of witnessing a signature necessitates the signatory signing the document in the physical presence of the witness. This cannot be achieved remotely as the witnessing person could not testify with absolute confidence that the signatory has signed a given document.

Can a relative witness a deed?

Who can be a witness to the signatory of a deed? A witness should not be the signatory’s spouse or partner or a family member, and should not have a personal interest in the provisions of the document. Case law has confirmed that a party to the document cannot act as a witness to another party’s signature.

Does a deed need to be witnessed NSW?

(1) Every deed, whether or not affecting property, shall be signed as well as sealed, and shall be attested by at least one witness not being a party to the deed; but no particular form of words shall be requisite for the attestation.

Can a friend witness a mortgage deed signature?

A party to a deed cannot witness the signature of another party to the same deed (the rule in Seal v. Claridge (1881) (7 QBD 516 and 519)). If a mortgage lender is involved, it may stipulate rules regarding the witnessing of documents. Most lenders insist upon independent witnesses who are not minors.

Does a deed need to be witnessed?

When an individual executes a deed, their signature must be witnessed. A party to a deed cannot be a witness to another signature to that deed. However, it is best to ensure independent witnesses are sought to ensure unbiased evidence can be provided, if and when required.

What happens if a deed is not witnessed?

For example, if a deed is not witnessed but everything else is in place, courts have held that the document would still have legal effect but not as a deed. As such it will lose, for example, the presumption of consideration.

How should a deed be executed?

To be a deed the document must:
  1. be in writing.
  2. make clear on its face that it is intended to be a deed by the person making it or the parties to it.
  3. be validly executed as a deed by the person making it or one or more of the parties to it (section 1 of the Law of Property (Miscellaneous Provisions) Act 1989)

Can a deed be executed by an Authorised representative?

Typically, documents or deeds will be executed by a partner on behalf of a partnership. An authorised individual may only execute a deed on behalf of a partnership where, by a deed executed by all the partners in the partnership, they have been authorised to do so.

Is a deed signed or executed?

Nowadays, execution blocks on deeds (where the parties sign the document) state that the party has “signed, sealed and delivered” the deed. As such, you do not need to have a seal physically placed on the document.

Does a deed need to be witnessed Australia?

The signature must be witnessed

The witness must be present when the deed is executed. The execution block has been drafted so that it complies with the laws relating to execution of deeds by an individual in all states and territories in Australia.
