Child killer Eric Smith calls his crime ‘horrendous,’ ‘violent’

Child killer Eric M. Smith last week told a Parole Board he was angry he’d been abused by family and bullied by classmates so he took his frustration out on four-year-old Derrick Robie. “He didn’t deserve anything that I did to him; no one deserved that kind of violence,” Smith said at his April 11 parole hearing, transcripts released Wednesday show. “What I did to him was brutal.”

Now 34, Smith was just 13 when he lured Derrick into a wooded area near the boy’s Steuben County home and violently killed him in August 1993. Derrick was walking alone to a summer camp at a nearby park. Smith strangled Derrick, smashed his head with a rock and sodomized him with a stick. Smith was later convicted and sentenced to 9 years to life in prison.

For the seventh straight time Smith faced a three-member Parole Board, he was again denied. Authorities released transcripts from the hearing, held Friday at the Collins Correctional Facility in Erie County, about 25 miles south of Buffalo. Smith said he knows he is responsible for Derrick’s death and is remorseful for “what I’ve done to him and his family.” Smith told the Parole Board that, when he was 13, he didn’t trust anyone and felt everyone was out to get him.

“I took my anger and frustration and rage out on him,” Smith told the board, and explained that those emotions weren’t directed at Derrick, but his father, older sister and high-schoolers who bullied him. “I took it out on (Derrick) and he did not deserve that.” According to the transcript, Smith said he killed Derrick because he thought he would get into trouble if the boy got up and told on him. He claimed he thought that by inserting a stick into the boy, it would reach and “stop his heart.”

Smith described his own actions as “horrendous,” “violent,” “uncalled for and wrong.” He told the board that he believes he is not a threat to others as his values have changed and he has stayed out of trouble while incarcerated for nearly a decade.

“Who I was at age 13 does not exist,” Smith said. “That child that committed that crime, he’s gone. He’s never coming back.” Parole officials said that Smith appears to be making progress in institutional programs and has a clean discipline record. But said his release would be “incompatible with the welfare and safety of society.”

Smith was housed in a juvenile facility until 2001 when he was transferred to state prison. He is eligible for parole every two years and was first denied parole in August 2002. Smith is next scheduled to appear before the parole board in April 2016.
